Chanel defeated in logo infringement suit against Huawei

On April 21, according to a BBC report, French luxury brand Chanel lost its trademark dispute with Huawei.

 

The dispute began in 2017, when Huawei applied to the trademark office, the European Union Intellectual Property Office (EUIPO), for approval to register its computer hardware trademark. The trademark consists of two intersecting vertical semicircles. Chanel objected, claiming that the design was similar to its "double C" logo.

 

Thereafter, the trademark office rejected Chanel's opposition in 2019, stating that there were no similarities between the two trademarks and that there was no likelihood of confusion in the minds of the public. Subsequently, Chanel again challenged the ruling before European Court of Justice, which dismissed its appeal in a decision on Wednesday. The court ruled that although the two signs bear a certain degree of similarity, the semicircles are oriented differently and are visually distinct.
