Luckin Coffee Wins Trademark Infringement Case in Thailand

In February 2025, the Central Intellectual Property and International Trade Court of Thailand ruled in favor of Luckin Coffee in its trademark infringement lawsuit against Thailand’s 50R Group. The Court affirmed Luckin’s prior rights to the "Luckin Coffee" trademark and the deer-head logo, ordering 50R Group to cancel the relevant bad-faith registered trademarks, cease use of the infringing signs, and pay a one-time compensation of 10 million Thai Baht, plus ongoing damages of 100,000 Thai Baht per day starting from the filing date of the lawsuit in March 2024.

 

In December 2018, 50R Group first filed a bad-faith application for the "Luckin Coffee" trademark in Class 30 in Thailand, and subsequently applied for similar trademarks in multiple related classes. Its bad-faith registration strategy was characterized by copying the core English trademark while modifying the Chinese and device marks to avoid infringement allegations. Luckin had previously lost a rights enforcement case in Thailand in 2023, and this victory underscores the importance of overseas trademark protection for enterprises.
