It was recently learned that DJI and Insta360 submitted motions to dismiss to the U.S. District Court for the Eastern District of Texas on June 28 U.S. local time, respectively withdrawing their previously filed lawsuits and related counterclaims.
The parties' patent dispute primarily centers around Insta360's first product to enter the gimbal camera market—the Luna series handheld gimbal cameras. Previously, DJI and DJI Osmo had sued Insta360 for patent infringement in the U.S. District Court for the Eastern District of Texas. Insta360 subsequently filed a patent counterclaim against DJI in the United States on June 12, formally kicking off the parties' first patent litigation showdown in overseas markets. On June 29, the court dismissed the cases without prejudice.
Currently, DJI's patent infringement lawsuit against Insta360 has shifted to China, with DJI filing lawsuits against Insta360 in people's courts in multiple domestic locations several weeks ago. Among them, the case accepted by the Shenzhen Intermediate People's Court is scheduled to be heard on August 3. In response to DJI's domestic litigation, Insta360 stated that it will file counterclaims in multiple locations across China and simultaneously submit requests for patent invalidation regarding DJI's relevant patents to the China National Intellectual Property Administration (CNIPA).
